ROOM LEASE AGREEMENT
This Lease agreement is made on [Date], between [________], residing at [Address] herein referred to as Landlord and [________], residing at [Address] herein referred to as Tenant.
Wherein the Landlord rents to Tenant and Tenant rents from Landlord for residential use for his personal use, a room, located at [Address of the Room] referred as the Room.
TERM: The initial term of this lease shall be for a period of [duration] months to commence on [date of commencement], and shall come to an end on [Date of end of the Lease Agreement] the following terms and conditions:
RENT: The Tenant agrees that he shall pay to the Landlord as rent, for the Room, an amount of [Rent] Australian Dollars per month, payable by cash, without demand.
SECURITY DEPOSIT: It is agreed between both the parties that on execution of this Lease Agreement, the Tenant shall deposits with the Landlord, a Security Deposit of [Amount]Australian Dollars, as rental bonds. , receipt of which shall be acknowledged by Landlord, as security for the full and faithful performance by Tenant of this Lease Agreement, which shall be refundable by the Landlord to the Tenant within [Number of days] days from the date of surrendering the Room or termination of this Lease Agreement, provided Landlord may retain all or a portion of the security deposit for the following:
(a) non-payment of the agreed Rent by the Tenant to the Landlord; (b) damage to the Room, unless the damage is the result of normal wear and tear or the result of actions or events beyond the control of Tenant. (c) non-payment of any or all the utility charges applicable to the Room for which Tenant is responsible; (d) the expenses for bringing the Room back to a level of cleanliness equal to the time of commencement of the Lease Agreement. This provision shall be in reference to the New South Wales, Landlord and Tenant (Rental Bonds) Act 1977.
PEACEFUL ENJOYMENT: The Tenant shall conduct himself and require other persons on the premises with the Tenant's consent to conduct him in a manner that will not disturb other tenants' or neighbours' peaceful enjoyment of the other adjoining rooms. It is also agreed that the Tenant shall comply with the terms of any applicable local noise ordinances. This provision shall be in reference to the New South Wales, Residential Tenancies Act 1987 and the Residential Parks Act 1998.
EVICTION: Any failures by the Tenant to pay the agreed Rent when due shall constitute a default herein under and permit Landlord at its option to terminate this tenancy upon [number of days] days' written notice to Tenant. Upon such termination, all the leasehold rights granted to the Tenant under this Lease Agreement shall come to an end and the Tenant shall surrender possession of the Room.
All the conditions provided in this of Lease Agreement are separate, the validity of each not being dependent upon the other. This Lease Agreement constitutes the entire agreement between the parties. The breach of any condition of this lease is to be considered substantial. This Lease Agreement shall be construed according to the New South Wales Office of Fair Trading.
