FREE Australian General Agreement

This basic free General Agreement can be used in Australia to put in writing the terms of any basic contract brtween two parties.

GENERAL AGREEMENT

This Agreement is made on this day of ___________ by and between:

[Name of the Person engaging services] [address of the Person engaging services] hereinafter referred as the “XXX”, which expression shall mean and include his legal heir and successors

AND

[Name of the Service Provider] [address of the Service Provider] hereinafter referred as the Service Provider, which expression shall mean and include his legal heir and successors.

This agreement is for the following activities, which the Service Provider shall provide to XXX as agreed between both the parties.

The term of this agreement shall be for a period of [Year] year (“term”) with an option of further renewal on the same terms and conditions or as agreed between both the parties. This agreement may be terminated by either of the parties by giving one month advance notice to each other.

The Service Provider shall perform the following services without fail for XXX, on or before expiry of every 1st day of month. The Services shall be the following:

The fee shall be AUS $ [Free] per month, and shall be payable after the expiry of every month’s services performed by the Service Provider.

Time is of the essence of the contract. Any delay by the Service Provider in performing his obligations under the contract which is caused by an event beyond the control of the Service Provider.

The contract shall not be assigned in whole or in part by the Service Provider without the prior written consent of XXX, and any assignment made without that consent is void and of no effect.

This Agreement shall be governed by the laws of State of [State] in Australia. Any dispute, controversy, proceedings or claim arising out of this Agreement shall be deiced as the Institute of Arbitration & Mediators Australia (IAMA) and shall fall within the jurisdiction of the courts of [State] in Australia.
