FREE Australian Sub Contractor Service Agreement

SUBCONTRACTOR SERVICE AGREEMENT

This Sub-Contractor Service Agreement (“Agreement”) is made on [Date] by and between:


[Name], having his permanent place of residence at [Address] hereinafter known as the Owner;


AND



[Name], having his permanent place of residence at [Address] hereinafter known as the Sub-Contractor.


WHEREAS the Subcontractor is in the business of [Business] and has represented to the Owner that the Subcontractor is capable of performing all the terms and conditions as provided in this Agreement.


NOW THEREFORE in consideration of the recitals, the mutual covenants hereinafter set forth, and for other good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, the parties hereto hereby agree as follows:



SubContractor’s Services: The Subcontractor shall, during the term of this Agreement, provide the following services to the Owner:

Timing of Services: The Sub-Contractor shall provide the services as and when required by the Owner.



Payment. The Sub-Contractor shall submit a “time and materials” monthly invoice to Owner at the address set forth above for the amounts properly due under this Agreement. Subject to the conditions for payment and limitations on liability set forth herein, Owner shall pay Sub-Contractor within thirty (30) days after Owner’s receipt of an invoice.



Performance. Sub-Contractor shall perform all Services diligently and in a good, professional and first class manner, using good quality materials, equipment and workmanship and sufficient trained personnel (including supervisors when appropriate) to complete the Services in a safe and timely manner which does not unduly interfere with the operation of the Property, the businesses therein and their suppliers.



Independent Contractor. The Sub-Contractor shall be an independent contractor, and all persons working under the direction of Contractor shall be employees of Sub-Contractor and not of Owner.



Governing Law: This Agreement shall be construed and enforced in accordance with the laws of the State of [State], Australia.
